Terms of Service

These terms govern your use of the Weatherpipe app and the weatherpipe.com website. Using either means you agree to what's below. If you don't, please don't use them.

I.The agreement

These Terms of Service form a binding agreement between you and NB Holdings, LLC, a single-member limited liability company registered in Wisconsin, United States ("Weatherpipe," "we," "us"). By installing, opening, or using the Weatherpipe app or website, you accept these terms. If you're using Weatherpipe on behalf of an organization, you confirm you have authority to bind that organization to these terms.

These terms work alongside the Privacy Policy, which describes what data the app handles. The Privacy Policy is incorporated into these terms by reference.

II.License to use the app

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and run Weatherpipe on devices you own or control, for your own use. You don't get any ownership of the app itself; we keep all rights we don't explicitly grant here.

On iOS, your license is also subject to Apple's Licensed Application End User License Agreement; on Android, it is also subject to the Google Play Terms of Service. Where those terms conflict with ours on platform-mandated points, the platform terms control for that platform.

III.Subscriptions, trials, and lifetime purchases

Weatherpipe is a paid app. We currently offer two purchase options, side by side, on the in-app paywall:

  • Annual subscription with a free trial — full access during the trial; the subscription begins automatically at the end of the trial unless you cancel before it ends.
  • Lifetime purchase — a one-time payment for ongoing access on the platform you bought it on.

All purchases are processed by Apple (App Store) or Google (Google Play), depending on the device you bought on. Billing, auto-renewal, price changes, currency conversion, taxes, and receipts are handled by the platform. Manage or cancel subscriptions in your platform account settings — not in the app.

Refunds. Because Apple and Google collect payment, refund requests go through them. Apple handles refunds at reportaproblem.apple.com; Google handles them under the Google Play refund policy. We cannot refund a charge we never received. If a platform refund is denied and you believe the situation is unusual, write to support@weatherpipe.com and we'll see what we can do.

Lifetime scope. "Lifetime" means the operating life of the Weatherpipe app on the platform you bought on, for as long as we keep that platform supported. It does not promise the app will exist forever, and it doesn't transfer between platforms — a Google Play lifetime purchase doesn't unlock Weatherpipe on the App Store, and vice versa.

Price changes. We may change prices for new purchases at any time. Existing annual subscribers will be notified ahead of any renewal that costs more than the previous cycle, per the platform's rules; you can cancel before that renewal if you don't want to continue. Lifetime purchases are not re-billed.

IV.Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or extract the source code of the app, except where local law expressly allows it.
  • Use the app's API or servers in a way that interferes with other users — for example, automated scraping, request flooding, or attempts to bypass our rate limits or API-key protections.
  • Resell, sublicense, or redistribute the app or any of the data it returns.
  • Remove or obscure any copyright, attribution, or other notices.
  • Use the app to break the law or infringe someone else's rights.

We may rate-limit, suspend, or block access from a device or IP that we reasonably believe is engaged in this kind of abuse.

V.Weather data is informational

Weatherpipe shows forecasts and observations sourced from Open-Meteo, with place-name lookups via OpenStreetMap / Nominatim. Weather forecasting is inherently uncertain, the underlying data can be delayed, incomplete, or wrong, and we do not independently verify it.

Do not rely on Weatherpipe for life-safety decisions. That includes — but is not limited to — aviation, marine, commercial, agricultural, or emergency-response use, and any decision involving severe weather, evacuation, flood, fire, or similar hazard. For those situations, defer to your national meteorological service (in the U.S., the National Weather Service), local emergency authorities, and certified domain-specific forecasts (for example, FAA aviation weather or NOAA marine forecasts).

Weatherpipe is a consumer convenience app. Treat it as one.

VI.Availability and changes

We try to keep the app and the API behind it running, but we don't guarantee uninterrupted service. We may add, change, or remove features; pause the service for maintenance; or discontinue the app entirely. Where reasonable, we'll give notice in the app or at this site; in the case of discontinuing a paid feature you actively rely on, we'll do our best to provide a sensible wind-down.

VII.Disclaimers

The app and the website are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that forecasts will be correct, that the app will be free of bugs, or that any defect will be fixed. Some jurisdictions do not allow the exclusion of certain warranties, in which case the exclusions above apply only to the extent permitted by law.

VIII.Limitation of liability

To the fullest extent permitted by law, NB Holdings, LLC and anyone working with us will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of Weatherpipe — even if we've been told such damages were possible.

Where liability cannot be excluded by law, our total aggregate liability for all claims arising from or related to Weatherpipe is limited to the amount you actually paid us through the relevant platform in the twelve months before the event giving rise to the claim, or USD 50, whichever is greater.

Nothing in these terms limits liability that cannot be limited under applicable law (for example, for fraud or for death or personal injury caused by negligence).

IX.Indemnification

You agree to indemnify and hold NB Holdings, LLC harmless from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your misuse of the app, your violation of these terms, or your violation of someone else's rights.

X.Termination

You can stop using Weatherpipe at any time by uninstalling the app and, if applicable, cancelling your subscription through Apple or Google. We may suspend or terminate your access if you materially breach these terms — for example, by attempting to circumvent rate limits or by reverse-engineering the app. Sections that by their nature should survive termination (license restrictions, disclaimers, limitation of liability, indemnification, governing law) survive.

XI.Changes to these terms

We may update these terms from time to time. If a change is material, we'll bump the effective date above and surface a notice in the app. Continuing to use Weatherpipe after a material change means you accept the updated terms; if you don't, please stop using the app.

XII.Governing law and disputes

These terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-laws principles. Apple's, Google's, and your own local consumer-protection laws may grant you rights that this clause does not displace.

If a dispute arises, please write to support@weatherpipe.com first — most things can be sorted out with a quick email. Unresolved disputes will be brought before the state or federal courts located in Wisconsin, and you and NB Holdings, LLC consent to the exclusive jurisdiction of those courts, except where applicable law gives you the right to bring claims elsewhere (for example, in your country of residence).
